Privacy Policy

The information Acuven collects to produce a Report, the purposes for which that information is used, and the third parties to which it is disclosed.

This Privacy Policy (this "Policy") describes the information that Acuven ("Acuven," "we," "us," or "our") collects in connection with the production and delivery of a Report, the purposes for which that information is used, and the third parties to which it is disclosed.

This Policy describes the practices that Acuven follows. It does not constitute a representation that those practices satisfy the requirements of any particular privacy statute or regulation.

1. Definitions

In this Policy, the following terms have the meanings set out below:

  • "AI Search Engines" means ChatGPT, Perplexity, Gemini, Google's AI Overview, and Google's AI Mode.
  • "Customer," "you," and "your" refer to the business for which a Report is ordered and to the individual who places the order on its behalf.
  • "Customer Information" means the information that a Customer submits through the Order Form, the record of the Customer's order, and the Report produced for the Customer.
  • "Order Form" means the form on this website through which a Report is ordered.
  • "Report" means the one-time report that Acuven produces for a Customer, as described in this Policy.
  • "Report ID" means the sixteen-character identifier printed on the Customer's receipt.
  • "Service Providers" means the third parties described under "Service Providers and Disclosures" below.

2. Scope of This Policy

Acuven provides a single product: the Report, which measures whether the Customer's business appears in the answers that the AI Search Engines give to questions of the kind a prospective patient would pose. This Policy concerns the information that the production and delivery of a Report require, and the information that this website receives from its visitors.

3. Information We Collect

Through the Order Form, Acuven collects only the information that the measurement requires, namely:

  • the name of the business;
  • the address of the business's primary website;
  • the street address of each location to be measured;
  • the services that the Customer selects from a list presented on the Order Form;
  • the concerns that the Customer selects from a list presented on the Order Form; and
  • the email address to which the Report and the receipt are to be sent.

All other information that the Report requires is derived from the information listed above. The name, city, and metropolitan area of each location, and the map coordinate from which each search is conducted, are derived from the ZIP code of the address entered. The pages of the Customer's website that are reviewed are located by reading the website itself, beginning at its primary address. The competitors identified in the Report are determined by the measurements themselves, and the Customer is not asked to name them.

When an order is placed, Acuven also records the IP address from which the Order Form was submitted and keeps it with the record of that order. The IP address is used only to detect and prevent fraud and misuse of the Order Form and the checkout, and for no other purpose.

Acuven does not request a telephone number, a date of birth, a job title, or any other information concerning the Customer personally beyond the email address to which the Report is sent.

4. Information We Do Not Collect

Acuven does not collect health information of any kind. Acuven's Customers are businesses, and all information that Acuven measures is publicly available, consisting of web pages accessible to any visitor and the answers that the AI Search Engines give to any person who submits a query. Acuven does not request, receive, or process any information concerning a Customer's patients.

Acuven does not collect account credentials. The service requires no account registration and no password. Retrieval of a Report requires only the Report ID and the email address with which the Report was purchased.

Acuven does not collect payment card details. Payments are processed by Acuven's payment processor through secure card fields embedded in the checkout page. Card numbers are transmitted directly to the payment processor and do not reach any server operated by Acuven. Acuven receives confirmation that a payment has succeeded, together with the email address associated with that payment.

5. Service Providers and Disclosures

Acuven provides Customer Information to third-party service providers that enable Acuven to produce and deliver the Report, process payments, send email, protect the Order Form from misuse, and operate this website. Because the Report measures the answers that the AI Search Engines give, the queries submitted to those engines include the Customer's business name, services, and city.

Each Service Provider's treatment of the information it receives is governed by that Service Provider's own privacy terms.

Acuven does not sell or trade Customer Information and does not disclose it to any third party for that third party's own advertising purposes.

Information about a business that is publicly available, including its website, its public listings and reviews, and the answers that the AI Search Engines give about it, is not Customer Information. Such information may appear in a Report prepared for another Customer, including where that business is itself a Customer and is measured as a competitor. Acuven does not disclose to any Customer that another business is or has been a Customer.

6. Cookies, Analytics, and Advertising Technologies

Acuven and its Service Providers may use cookies, pixels, tags, local storage, and similar technologies (collectively, "Tracking Technologies") on this website. Tracking Technologies are used to operate the website and the Order Form, to protect them from misuse, to measure how visitors find and use the website, to evaluate the effectiveness of Acuven's marketing, and to present Acuven's advertising to visitors on other websites and platforms.

Information collected through Tracking Technologies may include the visitor's IP address, device and browser characteristics, approximate location derived from the IP address, the pages viewed and the actions taken on them, the website or advertisement through which the visitor arrived, and the date and time of each visit. The website's typefaces are retrieved from a third-party font service, which receives the visitor's IP address and browser information when a page loads. Payment card details are entered only into the payment processor's secure fields and are not accessible to Tracking Technologies.

Tracking Technologies fall into the following categories:

  • Essential technologies, which are required for the website, the Order Form, and the checkout page to function and to be protected from misuse.
  • Analytics technologies, which measure the use and performance of the website.
  • Advertising technologies, which measure the results of Acuven's advertising and permit Acuven to present its advertising to persons who have visited the website. An advertising platform may combine this information with information that it holds about the visitor, subject to that platform's own privacy terms.

Visitors may block or delete cookies through their browser settings, and may limit interest-based advertising through the settings that advertising platforms provide and through industry opt-out programs. Blocking essential technologies may prevent the Order Form or the checkout page from functioning.

Acuven does not currently respond to browser "Do Not Track" signals, as no uniform standard for those signals exists. Where applicable law requires Acuven to honor a Global Privacy Control signal, Acuven shall do so.

Acuven shall update this section as its use of Tracking Technologies changes.

7. Communications

Email sent by Acuven is transactional and is limited to the Report, the receipt, and any notice that a matter concerning the Customer's order requires the Customer's attention. Acuven maintains no marketing list, and placing an order does not add the Customer to any such list. Any email from Acuven that does not concern an order placed by the recipient shall include an unsubscribe link, and Acuven shall honor any request made through that link.

8. Data Retention

Acuven retains the Report, the answers returned by the AI Search Engines, and the record of the Customer's order for as long as Acuven operates this service. That retention permits the Report ID and the purchase email address to continue to function after delivery. Records of payment may also be required for accounting purposes or in connection with a dispute long after a Report has been delivered.

Acuven has not established a fixed deletion date and shall not publish one that it would not observe. A Customer may request earlier removal of its record in accordance with "Access, Correction, and Deletion" below.

Separately from order records, Acuven retains the measurements themselves, being the answers that the AI Search Engines gave concerning a market on a given date, and may use those measurements in de-identified form, whether aggregated or stripped of the details that would identify the Customer's business, to improve the service and to study the behavior of the AI Search Engines. Acuven shall not attempt to re-identify measurements used in that manner, and any party with which Acuven shares them shall be held to the same restriction.

9. Access, Correction, and Deletion

A Customer may submit a request for access, correction, or deletion to hello@acuven.com. Acuven shall respond within three business days. Upon such a request, Acuven shall disclose the information it holds concerning the Customer's business, correct any inaccuracy, and delete the information that it is able to delete. Certain information cannot be deleted: a payment record is held by the payment processor as well as by Acuven and is retained for accounting and dispute purposes. Deletion of an order record causes the associated Report ID to cease to function, and Acuven shall so advise the Customer before proceeding.

This section describes the actions Acuven takes upon a Customer's request. It does not constitute a representation that any statute confers these rights on the Customer.

10. Information Security

Acuven maintains reasonable safeguards designed to protect Customer Information from unauthorized access, use, and disclosure, and restricts access to Customer Information to persons who require it. Acuven does not publish the details of those safeguards.

The Customer is responsible for safeguarding the Report ID, the receipt, and access to the email account to which the Report is sent. Any person who holds the Report ID and the purchase email address is able to retrieve the Report, and Acuven is not responsible for access to a Report obtained through the Customer's own accounts, devices, or systems.

No system is entirely secure, and Acuven cannot guarantee that information transmitted over the internet or stored on its systems will not be accessed by an unauthorized party. In the event of unauthorized access to Customer Information that affects a Customer, Acuven shall notify that Customer.

11. Identity and Contact

This service is operated by Acuven, which may be contacted at hello@acuven.com. Email is the sole channel of contact; Acuven does not maintain a telephone line or a chat service.

12. Changes to This Policy

The date at the top of this page indicates when this Policy was last revised. Acuven does not publish prior versions. If a revision is material to an order that a Customer has already placed, Acuven shall notify that Customer by email.
