Terms of Service

1. Scope of the Service

One report, provided once. It measures whether your business appears in the answers that five AI Search Engines give, namely ChatGPT, Perplexity, Gemini, Google's AI Overview, and Google's AI Mode, when a person poses the questions a prospective patient would pose. You pay once and we deliver once. There is no subscription, nothing renews, and no account is created.

2. Nature of the Report

The report is a record of what those engines actually answered, on the dates that the report names, for the locations that the report names. Every run carries its own date and the location from which it was searched, by design, so that you may always determine the window that your data covers.

It is a measurement, not a prediction and not a promise. We do not guarantee that you will appear, be recommended, or advance in any respect, because no party controls what an AI engine says, whether Acuven, an agency, or the engines' own users. Should the same question be posed a week later, the answer may differ. That is the nature of the subject being measured, and it is the reason the report is dated.

Nor will we overstate the channel to you. AI search volume in local service categories is modest at present and growing quickly, and the report states as much where the figures so indicate. What you are purchasing is a clear assessment of your standing and a specific list of remediations, not a representation as to the present month's traffic.

3. Information and Representations

The measurement is only as accurate as the business at which it is directed. You provide the business name, the website, and each location's street address and ZIP code. We use the ZIP code to situate the location in the correct city and metropolitan area, and because an incorrect address measures a different business, each address should be entered with care.

You may direct a report at your own business or, for purposes of market research, diligence, or competitive analysis, at another business. What we measure is public in either case, comprising web pages that anyone may open, the answers that the engines give to anyone, and public listings and reviews, and accordingly no permission from that business is required in order to measure it.

By placing an order, you represent three matters: that you are authorized to place the order and to use the payment method you enter; that the details you have entered are accurate; and that you are purchasing the report for business purposes and not for personal or household use. You further agree to use the report lawfully and not to harass, disparage, impersonate, or mislead any person by means of it.

4. Payment

The price is displayed on the order form before you pay and again at checkout. Payment is taken once, through Stripe's secure card fields embedded in our order page, and a receipt is sent to the email address you provided. That receipt bears your sixteen-character Report ID, which you should retain.

5. Delivery

The report arrives by email as a PDF, together with the Report ID and a link that fetches it again. While it is being produced, a status page shows you which step it is on.

We begin producing your report as soon as your payment goes through, so there is no cancellation window once you have paid; the work is already under way. If something goes wrong with it, the Refunds section below is how that is handled. You may access your status and finished reports at any time by visiting acuven.com/retrieve-report and entering your Report ID.

The time needed to complete a report may vary and depends on how many locations and how many metro areas are being measured, and on how busy the queue is. It is not a guarantee: we do not offer a guaranteed delivery time and nothing on this site should be read as one. If an order runs past the estimate you were shown it does not indicate a failure. You may email us at hello@acuven.com for questions on your report's timing and status and we will provide an update until the report is completed and delivered to you. That is the help we can offer here, and it is not a promise of a refund, a credit, or any particular outcome. The Refunds section below explains how those decisions are made.

6. Geographic Availability

We offer this service to businesses located within the United States. The measurement is constructed around United States addresses and United States metropolitan markets, and the order form will not accept an address outside the United States.

The foregoing is a limitation on the persons to whom we sell, and not a representation as to any other matter. If you are located outside the United States, this service is not offered to you.

7. Retrieval of the Report

The sixteen-character Report ID, together with the email address with which the purchase was made, will return your report, the PDF, and the receipt, without any login. That arrangement is convenient, and it also means that any person holding both items is able to retrieve the report. The receipt should be treated accordingly.

You are responsible for safeguarding the Report ID, the receipt, and access to the email account with which the purchase was made. Acuven is not liable for any access to or use of a report that results from the compromise of your email account, devices, or systems, or from your disclosure of those items to any other person.

8. License and Permitted Use

The report document is the property of Acuven. What you purchase is the right to use it, and that right is broad within your business and narrow beyond it. The right is personal to you and non-exclusive. You may not transfer, resell, or sublicense it beyond the persons working on it on your behalf as described below, and it terminates upon your breach of these Terms.

Within your business, you may use the findings as you see fit, act upon them yourself, and share the report or the remediation list with any person working on it on your behalf, including your web developer, your agency, your staff, and your accountant. You need neither request our permission nor notify us.

Beyond your business, you may not resell the report, publish it in full, repackage it as your own product or service, or use it as a sample of your own work. Quoting a figure from your own report in your own marketing and internal documents is permitted. Delivering the whole document to a third party as a work product is not.

The facts in the report are facts, and we do not assert ownership of them. What we protect is the document itself, comprising its wording, its structure, and its composition.

9. Restrictions on Use

The following restrictions apply in addition to the license granted above. Certain of them derive from the terms under which our data providers make their data available to us.

You agree that you shall not use the report or its findings to harass, disparage, impersonate, or mislead any person; shall not extract, resell, or redistribute the underlying search, listing, or review data as data; shall not reverse-engineer or reconstruct those data feeds from the report; and shall not use the report or any data contained in it for any unlawful purpose.

You further agree that you shall not use the search-engine data in the report, including Google and the AI Overview and AI Mode results, to compete with or cause harm to the search engines from which that data originates, or in any manner that violates those engines' terms of service or legal rights. Should a claim reach Acuven as a result of your use of the report or its data in breach of this provision, the indemnity set forth under "Indemnification" below shall apply.

10. Acceptable Use and Order Acceptance

You shall not use automated means to access or submit the order form, or circumvent any rate limit or other protective measure applied to this website.

We may decline an order, and we may cancel one, for any lawful reason, including an order for a business over which the person ordering has no authority, a business that we cannot sensibly measure, or a customer who abuses the form, the service, or the persons answering the email. If we cancel before the report has been produced, your payment will be returned to you.

11. Independence and Trademarks

Acuven is independent. We are not affiliated with, endorsed by, or partnered with any AI Search Engine, search company, or marketing agency. Engine and company names appear in the report and on this site solely to identify the systems that we measured, and those marks belong to their respective owners.

Product and service names such as Botox and CoolSculpting are trademarks of their respective owners. They appear solely to describe the treatments that a business offers and the searches that we measure. Acuven is not affiliated with, endorsed by, or sponsored by their owners.

12. Disclaimer of Results

Acuven provides a measurement and does not guarantee any outcome. The purchase of a report does not entail that any AI Search Engine will name your business, that your business will appear where it did not previously appear, that your position will improve in any respect, or that you will receive any additional inquiry, patient, or booking beyond what you would otherwise have received. No party, including Acuven, is able to cause an AI Search Engine to recommend a business.

The measurements pertain to the window that the report names, and they are not predictions. Should the same question be posed a week later, the answer may differ. That is a fact concerning the subject being measured, not a defect in the measurement, and it is the reason every figure is dated.

The engines are the products of other companies. They alter their answers, their behavior, and their rules at their own discretion, ordinarily without notice and at times without announcement. Any one of them may change its operation, or cease to exist, between the date on which we measure and the date on which you read the report. None of that is within our control, and none of it is a matter for which we may be held responsible.

The report is information, not advice. It does not constitute legal, medical, financial, or professional advice of any kind, and every decision that you make after reading it is yours.

13. Refunds

Your payment is for a single report produced and delivered to you. If the report does not arrive, or if a factual detail in it concerning your own business is incorrect by reason of an error in the manner in which we produced it, submit a request to hello@acuven.com within 7 days (of delivery, or of your order date if the report never arrived), stating your Report ID and the specific problem. We review every request individually and respond within three business days, and at our discretion we will re-run the report, correct it, or refund it. Refunds are not automatic, and we do not guarantee a turnaround time. When a refund is granted, it is returned to the original payment method.

A report measures what the AI engines and public sources actually returned. If a detail is incorrect by reason of its being incorrect at its source, for example your own website, your Google Business Profile or other listings, or other public information that you manage or influence, the report has correctly reported what that source states, and that is not a basis for a refund. Disagreement with an accurate finding, or a change in your circumstances after delivery, is likewise not a basis for a refund. Except as described in this section, all sales are final.

14. Warranties and Limitation of Liability

The report is sold as it is. Beyond what is stated on this page, we make no warranties concerning it, and to the fullest extent permitted by law we exclude the warranties that the law would otherwise imply, including that it is fit for a particular purpose, that it is free of errors, and that this site and this service will at all times be available.

What we do stand behind is stated in the report itself, namely the method, and the source from which each figure was measured.

If we are found liable to you in connection with a report, this site, or this service, however that liability arises, the maximum aggregate amount that we may owe you is the amount that you actually paid us for that report.

We are not liable for consequential losses, including lost business, lost profit, lost data, the time of another person, work that you commissioned by reason of a finding, or anything that you elected to do or to refrain from doing after reading the report.

A portion of the foregoing cannot be excluded in certain jurisdictions. Where it cannot be excluded, it does not apply to you, and the remainder of this page continues in effect.

15. Indemnification

Measuring a business's public footprint is lawful and requires no person's permission, and ordering a report concerning another business is therefore permitted. What is not permitted is the misuse of the report or the provision to us of inaccurate details, and if such conduct draws a claim toward us, as the party that conducted the searches, produced the report, and sent it, even a claim without merit imposes a cost in money and time to answer.

You agree to defend, indemnify, and hold Acuven harmless from any claim, demand, loss, liability, or cost, including reasonable attorneys' fees, brought by any other party and arising from any of the following: details that you provided to us that were inaccurate; your use, sharing, or publication of the report, including any use to harass, disparage, impersonate, or mislead; a payment that you were not authorized to make; or your breach of these Terms or of the law. You shall conduct and pay for the defense of such a claim; we may participate in our own defense with our own counsel at our expense; and you shall not settle any matter that imposes an obligation upon us without our written agreement.

This provision continues to apply after your report has been delivered.

16. Governing Law and Dispute Resolution

These Terms, and any matter relating to a report, this site, or this service, are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules.

In the event of a disagreement that we are unable to resolve through discussion, that disagreement shall be resolved by binding arbitration seated in Colorado, before a single arbitrator, rather than in court. Either party may nonetheless bring a qualifying claim in small-claims court instead.

The arbitration shall proceed on an individual basis only. You and Acuven each waive any right to bring or to participate in a class, collective, or representative action, and the arbitrator may not consolidate the claims of more than one person.

17. Changes to These Terms

We may change these Terms. When we do, the revised version is posted on this page and the date at the top is updated. That posting constitutes the notice.

Because there is no account and nothing renews, a change has no ongoing arrangement upon which to operate. The Terms displayed here on the day you purchase a report are the Terms governing that purchase, and a later change does not apply retroactively to it.

18. General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Acuven concerning a report, and they supersede anything stated or written beforehand.

If any provision of these Terms is found unenforceable, that provision is narrowed to the extent enforceable, or severed if it cannot be narrowed, and the remainder continues in force.

Our failure to enforce a provision of these Terms immediately does not constitute a waiver of that provision.

We are not responsible for any delay or failure caused by a matter beyond our reasonable control, including an outage or a change at one of the external services upon which the report depends.
